1. Introduction
These Terms of Service ("Terms") govern your use of the website and services provided by Goal Mark Projects ("we", "us", "our"). By accessing our website or engaging our services, you agree to these Terms.
2. Services
We provide software design, development, integration and related services, including ready-to-run business systems for sales, Sacco, farming, HR and web. The specific scope of any engagement will be defined in a separate written agreement or proposal.
3. Quotations & Payment
Quotations are valid for the period stated therein. Payment terms, milestones and any deposits will be set out in your project agreement. Late payments may result in a pause of work or services.
4. Intellectual Property
Unless otherwise agreed in writing, ownership of custom-developed software transfers to the client upon full payment. We retain rights to our pre-existing tools, libraries and know-how used to deliver the work.
5. Client Responsibilities
You agree to provide accurate information, timely feedback and any access or materials reasonably required for us to deliver the services. Delays in providing these may affect timelines.
6. Third-Party Integrations
Our systems may integrate with third-party services (for example payment gateways or KRA eTIMS). We are not responsible for the availability, changes or failures of those third-party services, though we will make reasonable efforts to support integrations.
7. Support & Maintenance
Support and maintenance may be included for a defined period or offered under a separate plan. Details will be specified in your agreement.
8. Warranties & Liability
We deliver services with reasonable skill and care. To the maximum extent permitted by law, our total liability arising from any engagement shall not exceed the fees paid for that engagement. We are not liable for indirect or consequential losses.
9. Confidentiality
Each party agrees to keep confidential any non-public information disclosed during an engagement and to use it only for the purpose of delivering or receiving the services.
10. Termination
Either party may terminate an engagement as provided in the project agreement. Fees for work performed up to termination remain payable.
11. Changes to These Terms
We may update these Terms from time to time. The latest version will always be available on this page.
